Supreme court, kerala blogger and Shiv sena


Okay here we go , A kerala blogger kinda opened up an orkut account and started an anti shiv sena campaign. Some person is maharashtra filed a criminal case against him. well, since a case was filed in maharashtra , he was asked to appear before a maharashtra court. The blogger rightly expressed his fear that his life was under threat and therefore he is scared to appear in the maharashtra court. But ofcourse he has to appear for the hearing if the supreme court thinks that he has to.

Well, well, what have we here?

Btw, that is the matter so far... The supreme court hasn't gone ahead and passed an ordinance against blogger's freedom at all.It cannot do so under law. It can provide stipulations and regulations while treating blogging as a new and expanding medium of democratic rights and publishing.Each one of us has a right to express our opinions within the realms of truth or opinion.Any false claims not backed up proof leading to the damage of image of another person is illegal not just in blogging but also anywhere else.So , there is nothing new there.

yes, the supreme court can perhaps rule in specific cases where someone files a case where a specific harm to them has been incurred by a specific blogger.

Yes, responsible blogging is the ideal behavior expected of all bloggers. But other than that no one can legally really pose any restrictions on anyone blogging about anything.

All of us have a right to express our opinions on issues. yes, we also have a right to express displeasure and disliking to the policies of any public figure or organization. The supreme court can only get that blog plucked if it percieves that under law that particular blogger has gone ahead and straight on caused harm to someone without adequate proof. If you have proof that someone did so and so and you then go blog about it, even if that blog essentially points a finger at someone, as long as it is true and you have proof to back up your claims that you have claimed on your blog it is all good.

So yes, supreme court cannot curb the freedom of speech of bloggers at all.

chill all bloggers. It just asked a blogger to appear before court because a smear campaign was suspected. more news and discussion on this issue to follow in subsequent blogs
